Belgium E-Invoicing for Foreign Companies: When the Mandate Reaches You

Whether Belgium's B2B mandate applies to a foreign company turns on fixed establishment. What it means, what still reaches you, and who can serve you.

The short answer

Belgium's B2B mandate applies to businesses established in Belgium — which includes a foreign company with a Belgian fixed establishment, and VAT groups. A non-resident with no fixed establishment is not obliged to issue structured invoices.

That is where most people stop reading, and it is the wrong place to stop. You will still be sent structured invoices by your Belgian suppliers, and your Belgian customers increasingly expect to be invoiced the same way. The obligation may not reach you; the practice will.

The test that decides it: fixed establishment

The mandate keys off establishment, not registration. Those are different things and the distinction does real work here.

A Belgian VAT registration on its own does not create a fixed establishment. Plenty of foreign businesses hold one because they cross a distance-selling threshold, hold stock, or run an occasional taxable supply. That registration makes them a Belgian taxpayer for those transactions; it does not by itself give them the permanence and the human and technical resources that a fixed establishment requires.

Where the line falls in a marginal case is a question for your tax adviser, not a blog post — and it is worth asking, because the answer flips you between "must issue structured invoices for domestic B2B" and "need not, but must be able to receive them".

Two other exclusions apply regardless of where you are established: B2C is out of scope entirely, and businesses whose activity is exempt under Article 44 of the Belgian VAT Code are outside the obligation.

What reaches you even when the obligation does not

Three things, all of which cost money if you have not planned for them.

Inbound structured invoices. Your Belgian suppliers are obliged to issue them. If you are not reachable on Peppol, the send fails at lookup, and since Hermes closed there is no longer a fallback that quietly forwards it as a PDF. The failure is now visible and lands on your supplier's screen.

Customer expectation. A Belgian buyer whose accounts payable is wired for structured invoices has a smooth path for compliant suppliers and an exception queue for everyone else. Invoices in the exception queue get paid later. That is a working-capital cost with no fine attached to it.

The 2028 change. From 1 January 2028 Belgium adds near real-time e-reporting on a five-corner model, in which both parties report separately. If you have a fixed establishment then, you are one of those parties.

Your provider does not need to be Belgian

This is the part foreign companies most often get wrong, usually by assuming they need a local vendor.

Belgian law distinguishes two cases explicitly. Providers established in Belgium hold a service agreement with FPS BOSA. Providers established elsewhere are approved:

under an equivalent service contract concluded with the competent administration of the place of establishment of that service provider acting as a Peppol authority there

In plain terms: a certified Peppol access point does not need a Belgian entity or BOSA accreditation to serve Belgian businesses. Its standing comes from the agreement it already holds with its own Peppol Authority. You are free to choose on capability, coverage and price rather than postcode — and if you trade in more than one country, choosing a provider per jurisdiction is how you end up maintaining five integrations. One API across countries is the alternative.

A practical sequence for a foreign business

  1. Establish whether you have a Belgian fixed establishment. Ask your adviser; do not infer it from holding a VAT number. This single answer determines everything below.
  2. Get reachable either way. Register on Peppol under your own country's identifier scheme so Belgian suppliers can deliver to you. Receiving is cheap; being unreachable is not.
  3. If you are established, get issuing. Peppol BIS Billing 3.0, UBL 2.1, EN 16931. Belgium publishes no national CIUS, so there is nothing Belgium-specific to build beyond the identifier.
  4. Use the enterprise number for your Belgian entity — scheme 0208, with a valid mod-97 check digit. Not your VAT number.
  5. Handle both directions. The mandate is symmetrical for those in scope, and inbound is the half that is usually forgotten until it arrives.
  6. Plan 2028 while the code is open, rather than reopening it in eighteen months.
